Someone (identity unknown) sent an email to another person in Melbourne, Australia advising of my blog, My Daily Struggles. The recipient of the email read my blog for more than an hour. Most of the blog posts that the individual was curious about concerned my former psychologist, Nancy Shaffer, Ph.D. Don't you find that to be a "trivial event" under the law? As a lawyer licensed to practice in the Commonwealth of Pennsylvania, it is my professional opinion that that is, as a matter of law and fact, a trivial event. And, yes, I attached a negative meaning to that "trivial event" as defined by the District of Columbia Court of Appeals. I am posting this for legal reasons only: to advise The Powers That Be that under Freedman v. D.C. Dept. of Human Rights I continue to be unfit for employment.
According to the Court in Freedman my disorder may be associated with a risk of violent behavior, which would render me unemployable per The Americans With Disabilities Act by reason of business necessity. There is no evidence that I have ever engaged in a violent act, and I have no arrest record. I have never been a defendant in any civil matter in which I was accused of a violent act.
But as lawyers like to say during cross-examination, "Isn't it possible that . . . ?" " . . . That Freedman might become violent? Sure, it's also possible that we might get abducted by aliens!"
