RE: Arent, Fox, Kintner, Plotkin & Kahn Employment Inquiry - Homicide/Violence Risk

Dear Mr. Ruttenberg:

During the period March 1988 to October 1991 I was employed as a legal assistant at the law firm of Akin, Gump, Strauss, Hauer & Feld ("Akin Gump"). Attorney managers at Akin Gump terminated my employment effective October 29, 1991 upon determining, in consultation with a psychiatrist, that a complaint of harassment I had lodged against several co-workers was attributable to a psychiatric symptom ("ideas of reference") prominent in the psychotic disorders and typically associated with a risk of violent behavior. See Freedman v. D.C. Dept. of Human Rights, D.C. Superior Court no. MPA 95-14 (final order issued June 10, 1996). In the period immediately after my job termination senior Akin Gump managers determined that it was advisable to secure the office of my direct supervisor against a possible homicidal assault, which it was feared I might commit.

My records indicate that in early July 1992, within one year after my job termination by Akin Gump, I submitted an employment inquiry to Lynn Edwards-Hall at Arent, Fox, Kintner, Plotkin & Kahn ("Arent Fox"). I do not know what communications, if any, Lynn Edwards-Hall may have had with Akin Gump's attorney managers or supervisors at the time of this employment inquiry.

I have been under investigation by the U.S. Secret Service as a potential security risk to President William J. Clinton, and was interrogated at the Washington Field Office by Special Agent Philip C. Leadroot as recently as February 1996, about one year ago.

I request that you look into whether Arent Fox's records reflect the receipt of a job inquiry from me in 1992 and, if so, that you candidly disclose to federal authorities the content of any communications Arent Fox may have had with any senior Akin Gump supervisors or attorney managers, including Dennis M. Race, Esq. (whom I expressly designated as a job reference in my employment inquiry to Arent Fox), relating to the subject matter of my job termination by Akin Gump, including facts relating to the firm's alleged determination that I suffered from a paranoid mental state that rendered me potentially violent, or facts relating to the firm's concerns that I might have been armed and homicidal and possibly poised to carry out a homicidal assault on the firm's premises.

I note, incidentally, that former Arent Fox of Counsel, Fred D. Thompson, now a U.S. Senator, is currently associated professionally with Michael J. Madigan, Esq., a former Akin Gump partner who now serves as majority chief counsel for the Senate Governmental Affairs Committee. I know that Michael J. Madigan is an individual of the highest professional integrity, and that he will unreservedly clarify or elaborate the concerns of his former law partners, and their employees, regarding my mental stability and potential for violence (including murder).

The enclosed computer disc contains a document of purely psychological interest that I prepared that is consistent with assertions relating to my mental state (and potential for violence) made by the District of Columbia Office of Corporation Counsel in Brief of Respondent in Opposition to Petition for Review of no Probable Cause Determination by Department of Human Rights, Freedman v. D.C. Department of Human Rights, D.C. Superior Court no. MPA 95-14. The document, which refers to a former U.S. Secret Service protectee, may be relevant to an insanity defense in any possible future felony prosecution. According to the George Washington University Medical Center Department of Psychiatry, the document is the product of a psychotic mental state. Rest assured, I have provided a copy of the document to federal authorities.

Like yourself I am a graduate of the Pennsylvania State University (B.A., 1975). Unlike you, however, I have succumbed to a rare form of paranoid schizophrenia, a disabling psychotic disorder, that--according to the George Washington University Medical Center Department of Psychiatry--causes me to become more intelligent even as the illness worsens in severity.

Sincerely,

Gary Freedman

Michael J. Madigan is litigation partner in Orrick's Washington, D.C. office and former Akin Gump partner during my tenure there.

I'm sure he knows about me and my problems with Akin Gump.

Mr. Madigan has more than 30 years of experience in white collar criminal investigations, congressional and corporate investigations, corporate governance issues and Washington legislative and political issues. He began his legal career by serving as a federal prosecutor where he tried more than 100 jury trials, successfully prosecuting murderers, rapists, armed robbers, drug cartels and major fraud cases. At age 30, he served as Counsel to Senator Howard Baker on the historic Senate Watergate Committee. In addition, Mr. Madigan has served as Chief Counsel for Senator Fred Thompson’s Campaign Finance investigation, Counsel to the Church Committee and Minority Counsel of the Senate Intelligence Committee.

Prior to joining Orrick, Mr. Madigan was a partner at Akin Gump where he litigated large criminal and civil cases on behalf of corporate and individual clients in federal and state courts throughout the country, conducted corporate internal investigations and counseled on corporate governance and Foreign Corrupt Practices Act issues, and advised and defended officers and directors of corporations in civil litigation, criminal proceedings and congressional investigations.

Mr. Madigan has been listed in Best Lawyers in America for 15 consecutive years and is also currently listed for white collar crime in Superlawyers.com, Washingtonian’s Top Lawyers and Chambers USA.
