RE:  Margie A. Utley - D.C. Dept. of Human Rights - Hatch Act Investigation

Dear Ms. Day-Coch:

The enclosed documentation is offered for your information with respect to the above-referenced matter.

The documentation comprises a pleading filed with the D.C. Court of Appeals in docket no. 93-AA-1342, an appeal of final action of the D.C. Dept of Human Rights (DOHR) in agency docket no. 92-087-P(CN).

My former employer, the law firm of Akin, Gump, Strauss, Hauer & Feld, terminated my employment on October 29, 1991, days after I had complained to members of management that I was being harassed by various employees including my supervisor, Mrs. Christine Robertson.  Akin Gump later filed apparently fabricated evidence with the DOHR that it had determined in consultation with two mental health professionals, including a psychiatrist, that I suffered from a paranoid disorder and that I was potentially violent.  The supervisor in question was later found by a federal court, to have exhibited racial animus toward black employees under her supervision.

DOHR dismissed my unlawful termination complaint despite the persuasive documentary evidence I had offered that discrimination had occurred and that Akin Gump had filed false evidence with DOHR.

The appeal of this matter before the D.C. Court of Appeals is still pending.  The deputy D.C. corporation counsel, Mr. Charles L. Reischel, in a "statement in Lieu of Brief" filed with the court on March 4, 1994, declined to submit a reply brief in support of DOHR; such is the deputy corporation counsel's appraisal of the merits of DOHR's position.

You will note that a senior partner of Akin, Gump, Mr. Vernon Jordan, has close ties to the Kelly Administration.  Mr. Jordan headed up Mayor Kelly's transition effort following the 1990 mayoral election.

I have forwarded a collection of documents pertinent to this matter to Mr. Eric H. Holder, Jr., U.S. Attorney for the District of Columbia.  I have also brought this matter to the attention of the Washington Field Office of the FBI.

In fact the Corporation Counsel declined to defend the appeal because the court lacked jurisdiction. The decision not to defend was not based on the merits of the appeal.

Margie Utley was eventually found to have violated the Hatch Act.

In 1997 she was disbarred by the state of Georgia and D.C. for misappropriating estate funds.
