MOTION FOR LEAVE TO FILE DOCUMENTS OUT OF TIME

I, Gary Freedman, appellant in the above appeal request leave to file the following documents out of time pursuant to the order of this court dated August 15, 1996: motion to proceed in forma pauperis, docketing statement, and designation of record and statement regarding transcript. 1/

The aforesaid documents were improperly filed by appellant on July 8, 1996 in a Petition for Review captioned Gary Freedman v. District of Columbia Department of Human Rights, No. 96-AA-880. 2/  Appellant filed a Motion to Dismiss the said Petition for Review on August 30, 1996.

1/  The designation of record and statement regarding transcript were timely filed on July 8, 1996 with the Superior Court, Office of Appeals Coordinator, Room 3148.

2/  The instant civil appeal, no. 96-CV-961, and the Petition for Review, no. 96-AA-880, both seek review of a prior finding of no probable cause by the District of Columbia Department of Human Rights in Freedman v. Akin, Gump, Hauer & Feld, agency no. 92-087-P(N).

O R D E R

It appearing that the $50 docketing fee, docketing statement, designation of record and statement regarding transcript were due to be filed on or before July 17, 1996 (see D.C. App. R. 7A (a)(1) and 10), and have not yet been filed, it is

ORDERED that appellant shall, within 20 days from the date of this order, tender the $50 docketing fee and file the docketing statement with this court, and file the designation of record and statement regarding transcript with the Superior Court, Office of Appeals Coordinator, Room 3148.  It is

FURTHER ORDERED that the appellant shall simultaneously file a copy of those documents with this court accompanied by a motion for leave to file the documents out of time, and this court's $10 motion fee.  The motion should set forth good cause for the failure either to timely file the documents or to request an extension of time within which to do so.  Failure to comply with this order may result in the dismissal of this appeal.  See D.C. App. R. 14.
