U.S. Marshals Service: Accessory to Fraud and Racketeering
I emailed the following message to the Office of Inspector General of the United States as a concerned citizen. It is outrageous to me that a branch of the U.S. Department of Justice has allowed itself to be used to further a fraud and racketeering conspiracy run by the attorney managers of the law firm of Akin, Gump, Strauss, Hauer & Feld with the possible complicity of their friends at the highest levels of the federal government. What concerned citizen wouldn't be outraged?

Despite Respondent's concerns regarding my purported paranoid mental state and potential for violence, Dennis Race waited until shortly before noon on Tuesday, October 29, 1991 to advise me of the termination. One wonders why Mr. Race would have allowed me to be present on the premises for an additional day in view of his stated concerns.

The following statement contained on page 5 of Respondent's Response to Particulars (Attachment A), paragraph 3B, executed May 22, 1992, is hereby denied. Respondent's statement reads: "Until the filing of this Charge, the subject of Claimant's [sic] sexual orientation was never brought up by Claimant or anyone involved directly or indirectly with Claimant's employment. While Claimant raised concerns about sexual and religious harassment, he never stated that it was based on his sexual orientation -- nor was it ever interpreted as such by anyone involved in this matter (emphasis added)."
At the meeting on October 24, 1991 between Dennis Race, Malcolm Lassman and me, I can expressly recall that Mr. Lassman made the following statement to me: "We don't care what your sexual preference is; we don't care whether you like men or women."
Mr. Lassman's statement could only have been made in the context of a discussion that at least implicitly raised the issue of my sexual oritentation. Mr. Lassman's statement only makes sense if one infers that he interpreted my allegations of harassment at the meeting on October 24, 1991 as relating to the issue of my sexual orientation. The assertion to the contrary in Respondent's Response is disingenuous to say the least.
Further, I expressly recall relating Mr. Lassman's statement to Ms. Margie Adams of the D.C. Department of Human Rights during a meeting with her in early 1992 before I was to be apprised on December 23, 1992, upon my receipt of Respondent's Response, that Respondent had implicitly disavowed Mr. Lassman's comment made at the meeting on October 24, 1991.

Akin Gump: Gary P. Zanfagna, Esq.
Gary Zanfagna is Associate General Counsel and Chief Antitrust Counsel at Honeywell International Inc. Before joining Honeywell, Mr. Zanfagna was Assistant Director for Policy Planning at the Federal Trade Commission in Washington, D.C. At the Commission, he was one of the principal authors of the Antitrust Guidelines for Collaborations Among Competitors issued by the Commission and the Antitrust Division of the U.S. Department of Justice. Prior to joining the Commission, Mr. Zanfagna was an antitrust attorney with Jones Day in Washington, D.C. Currently, Mr. Zanfagna is a member of the Council of the ABA Antitrust Section. Mr. Zanfagna received his J.D. from the University of Virginia (1993) and his B.A. from the College of William & Mary (1988).
While I worked at the law firm of Akin, Gump, Strauss, Hauer & Feld (1988-1991) Mr. Zanfagna worked at the firm as a paralegal assigned to the Labor Practice Group; his time was devoted to Eastern Airlines litigation. He started working at the firm following his college graduation in 1988 and left the firm in the spring of 1990 in anticipation of entering law school in the fall.
Mr. Zanfagna was a friend of another paralegal at Akin Gump named Jesse Raben who also started law school in the fall of 1990. Both Zanfagna and Raben left the firm at the same time in the spring of 1990 to embark on a world tour together prior to continuing their education in the fall.
Zanfagna and I had very little contact. I remember sitting at the same table with him at the All-Attorneys dinner held on May 3, 1989 at the Westin Hotel, together with paralegals Raben, Clay Bailey, Jennifer Meader and Anthony Parchment. He seemed like a serious-minded chappie.
It was at the firm dinner on May 3, 1989 that Jesse Raben confirmed that there was a rumor at the firm that I was homosexual. See District of Columbia Reply Brief, Freedman v. D.C. Department of Human Rights, D.C.C.A. no. 96-CV-961 (Sept. 1, 1998).
In the late summer or early fall of 1989 I asked Zanfagna (in a second floor conference room) if he would go to lunch with me. He said, "Is this a date? Do you consider this a date? Because if it's a date I'm not going." Call me paranoid, but I saw homosexual implications in Zanfagna's questions. Both Zanfagna and Akin Gump Legal Assistant Coordinator J.D. Neary were graduates of William and Mary College. In the spring of 1988 I had formed the paranoid opinion that Mr. Neary had told another paralegal Jeffrey Wertman that I was homosexual.
In a sworn declaration Akin Gump attorney manager Dennis M Race filed with the D.C. Department of Human Rights (May 22, 1992) in a wrongful termination complaint I had filed with the agency, Mr. Race vehemently denied that the issue of my sexual orientation was ever raised by anyone at the firm: "B. Until the filing of this Charge, the subject of Claimant's sexual orientation was never brought up by Claimant or anyone involved directly or indirectly with Claimant's employment. While Claimant raised concerns about sexual and religious harassment, he never stated that it was based on his sexual orientation -- nor was it ever interpreted as such by anyone involved in this matter."

Akin Gump: Lilliam Machado, Esq.
During the earliest period of my tenure at the D.C. law firm of Akin, Gump Strauss, Hauer & Feld -- from March 4, 1988 to the summer of 1988 -- I was supervised by a paralegal named Lilliam Machado. Lilliam Machado left the firm to attend law school in the fall of 1988. She worked at the firm as a law clerk in the summer of 1990. She was exceptionally intelligent and mature; she stood out among the paralegals at the firm. I believe that when she first started working at the firm her office mate had been J.D. Neary, who later became the firm's legal assistant coordinator.
Lilliam Machado worked closely with John "Jack" Gallagher, Esq., the billing attorney for Eastern Airlines and David P. Callett, Esq., a senior attorney on Eastern; the respective offices of the three parties were adjacent to each other.
Lilliam Machado's husband was named Luis.
Lilliam Machado and I got on very well. I don't think it ever occurred to her that I might be potenially violent or homicidal.
She appeared to be in the loop regarding office gossip. It was she who told me in about May 1988 that the then Litigation Support Administrator Nancy Shaffer had been terminated by the firm for insubordination.
I had an idea of reference during the summer of 1990, while Lilliam Machado worked at the firm as a law clerk and I was in psychotherapy with Stanley R. Palombo, M.D., an expert in the creative process. I was walking out of the firm's office building onto 19th Street. I could hear Lilliam Machado talking to someone, walking behind me. I heard Lilliam Machado say, "He's an artist." I really have no idea who she was talking about, but I had the feeling her comment was directed at me. That was almost twenty years ago, but I still remember that.

I am currently in weekly psychotherapy with a third-year psychiatry resident named Jitendra Annapareddy, M.D. who is affiliated with St. Elizabeths Hospital. Dr. Annapareddy's supervisor is Earle Baughman, M.D. at St. Elizabeths. Dr. Baughman is a psychiatrist/psychoanalyst.
I derive no benefit from my work with psychiatry residents. None of the residents I have seen since 1992 has had any insights into my personality; they all seem baffled by me.

My mental state has always been stable. I do not now nor have I ever been deemed to be a threat to myself or others. I underwent a forensic psychiatric examination at D.C. General by Diane Martin, MD on October 12, 1994, who declined to admit me. I have never had a psych admission at any time in my life. I have no arrest record. I do not drink or take drugs.
I accept my circumtances stoically, but inside I feel desperate, as if I have been buried alive. I have no friends. I have been diagnosed with schizoid personality disorder. I have only one relative in the area, a sister who lives in New Jersey. I see her about once a year and I speak to her on the telephone about once week. I feel very alienated from other people and would derive no benefit from most group therapies. A psychiatrist told me many years ago, "You might benefit from group therapy, but it would have to be the right kind of group. You wouldn't fit into most groups."
I was wondering if I could set up a kind of pen pal relationship with you. I would write to you from time to time about my concerns, my thoughts, and my feelings. You don't have to respond. I am unable to communicate effectively with my current psychotherapist or any of the residents I have seen since 1992. Taub, M.D., provide the firm assurances that I did not pose a violence risk. I wrote the letter a brief time after the D.C. Court of Appeals issued on September 1, 1998 an Opinion and Judgment reaffirming an earlier agency determination that my job termination by Akin Gump in October 1991 was lawful under the D.C. Dr. Taub did not speak with Akin Gump. The firm did not respond to my offer. In February 1999 Dr. Taub filed a letter with the D.C. Medical Board falsely and deceptively stating that I suffered from paranoid schizophrenia of long-standing duration.
A curious thing happened after I posted the documents on this blog in December 2009. Someone at the Justice Department logged on to this post again and again for a few days. Why would the Justice Department have any interest in these particular documents?
Did the documents in any way expose Akin Gump to any legal liability? If so, why would the Justice Department have an interest in Akin Gump's legal exposure?

Akin Gump's Ties to the George Washington University
1. Randy L. Levine is Senior Counsel in the New York City office of the law firm of Akin, Gump, Strauss, Hauer & Feld. He also sits on the Board of Trustees of The George Washington University.
2. Heather S. Foley sits on the Board of Trustees of The George Washington University. She is married to Thomas S. Foley, former Democratic Speaker of the House of Representatives and retired Akin Gump partner.
Mr. Foley is from Spokane, Washington. He taught law at Gonzaga Law School in Spokane, where I spent my first year of law school (finishing in the top 15%). Mr. Foley is a personal friend of Akin Gump founding partner, Robert S. Strauss.
3. Bob Strauss has served on the Board of Trustees of the Ronald Reagan Institute of Emergency Medicine of The George Washington University.
I was a psychiatry out-patient at the George Washington University Medical Center Department of Psychiatry from 1992 to 1996, where I was diagnosed in September 1992 with bipolar disorder (Napoleon Cuenco, MD and Suzanne Pitts, MD). The illness went into spontaneous remission some time in 1993. Dimitrios Georgopoulos, MD diagnosed me with paranoid schizophrenia in 1996. William Fabian, Ph.D. diagnosed me with delusional disorder in May 1994 on the basis of comprehensive psychological testing that failed to disclose any mental illness or psychotic thought process. I took the Wisconsin Card Sorting Test in March 1996 (one month after Dr. Georgopoulos diagnosed paranoid schizophrenia), administered by Ramin Mojtabai, MD; I scored the lowest meaningful score -- 6 nonperseverative errors. (Less than 6 errors is pure chance). The test report states that I have high concept-formation ability.
My employment was terminated by Akin Gump on October 29, 1991. The employer claims that it learned in an ex parte consultation with George Washington University Clinical Professor of Psychiatry, Gertrude R. Ticho, MD (deceased), that a harassment complaint I had lodged against coworkers was symptomatic of "ideas of reference," which might dispose me to become violent. Gertrude Ticho's husband, the late psychoanalyst Ernst Ticho, Ph.D. was the mentor of Otto Kernberg, MD.
Dr. Otto Kernberg is an expert in organizational process and disturbed organizations.
Incidentally, Dr. Kernberg's daughter, Adine Kernberg-Vara, Esq. is a personal friend of Columbia Law Professor Jane Ginsburg, daughter of U.S. Supreme Court Justice Ruth Bader Ginsburg, a neighbor of Bob Strauss at The Watergate. Adine Kernberg-Vara and Jane Ginsburg coauthored a book several years ago. (A few years years ago I sent Justice Ginsburg a copy of my book, Significant Moments.)
Dr. Kernberg's late wife, Paulina Kernberg, MD, was the Justice Department's psychiatric consultant in the Elian Gonzalez immigration case from the late 1990s (while current U.S. Attorney General Holder served as Deputy Attorney General in the Clinton Administration).

Akin Gump -- DC -- Obsessive Interest in My Blog
In the fall of 2009 I began to devote this blog, My Daily Struggles, to my employment problems at the law firm of Akin, Gump, Strauss, Hauer & Feld -- and related issues. I subscribe to a service, Statcounter.com, that advises me of who logs onto the blog. Beginning in the fall of 2009, Akin Gump developed an obsessive interest in my Internet postings. The following indicates the statcounter data for Akin Gump for several days in March 2010. Several months ago, I stopped getting data on Akin Gump. Either the firm is no longer interested in my blog, or more plausibly, the firm has concealed its IP address.
Why is Akin Gump so obsessed with the statements of an individual whom the firm diagnosed as severely disturbed in October 1991 -- and remains disabled?
