Akin Gump -- Dallas Office -- Obsessive Interest in My Blog

In the fall of 2009 I began to devote this blog, My Daily Struggles, to my employment problems at the law firm of Akin, Gump, Strauss, Hauer & Feld -- and related issues.  I subscribe to a service, Statcounter.com, that advises me of who logs onto the blog.  Beginning in the fall of 2009, Akin Gump developed an obsessive interest in my Internet postings.  The following indicates the statcounter data for Akin Gump (Dallas) for several days in March 2010.   Several months ago, I stopped getting data on Akin Gump.  Either the firm is no longer interested in my blog, or more plausibly, the firm has concealed its IP address.

Why is Akin Gump so obsessed with the statements of an individual whom the firm diagnosed as severely disturbed in October 1991 -- and remains disabled?

Of Simple Country Lawyers

Canny Senator Sam Ervin of North Carolina, who liked to describe himself as ''just a simple country lawyer'' -- and proved that he was anything but -- served as chairman of the Senate's Watergate Committee.   Senator Ervin was a graduate of Harvard Law School.  He had graduated in 1917 from the University of North Carolina, where he was a member of The Dialectic and Philanthropic Societies.  I have no idea what that even is!

Of Dumb Blondes

Judy Holliday was an Oscar-winning American actress.

In 1950, Holliday was the subject of an FBI investigation looking into allegations that she was a Communist. The investigation "did not reveal positive evidence of membership in the Communist Party" and was concluded after three months. Unlike many others tainted by the Communist scandal, she was not blacklisted from movies, but she was blacklisted from performing on radio and television for almost three years.

In 1952, she was called to testify before the Senate Internal Security Subcommittee to "explain" why her name had been linked to Communist front organizations. In spite of her high IQ, which was measured at 172, she was advised to play dumb (like some of her film characters) and did so. She acknowledged that she "had been taken advantage of".

1. The law firm of Akin, Gump, Strauss, Hauer & Feld (DC) filed false sworn statements with a DC agency certifying that I suffered from severe mental illness that rendered me potentially violent. I used these false sworn statements to apply for Social Security Disability benefits. My disability claim is a total fraud and will end up costing the government about a half million dollars. Yes, I am currently engaged in the commission of a felony against the government of the United States.

Akin Gump: R. Bruce McLean and the Inscrutable Smile

I worked as a paralegal at the law firm of Akin, Gump, Strauss, Hauer & Feld from March 1988 to October 1991.  I have a specific recollection of a trivial event that occurred on the afternoon of October 28, 1991, the day before I was fired by the firm.

At about five or five-thirty in the afternoon I was waiting for an elevator on the firm's fourth floor.  At that time I was working in a private office on the fourth floor on a special project for the client Hoechst-Celanese under firm partner David P. Callet, Esq., who now practices at Greenberg Traurig, LL.P. 

While I was waiting for an elevator to go home I remember seeing a firm partner, R. Bruce McLean.  Mr. McLean smiled at me.  I thought it was just a friendly gesture.  I had no idea that the firm had decided to terminate me that very afternoon.  My severance check was dated October 28, 1991 by the accounting department.   Mr. McLean seemed to gaze at me as he was smiling.

What meaning do I attach to Mr. McLean's expression in retrospect?  I suspect he was thinking, "This is the last time I will see you.  You will be advised of your termination tomorrow.  You've done a tremendous job for us and we are very grateful for your work.  Yes, we're firing you, but believe me, we're doing you a favor.  You don't really want to continue working here in this environment, given these circumstances."  Well, in any event, that is my projection.  Is my reaction that of a severely disturbed person?  Was Mr. McLean's expression consistent with the firm's alleged determination that I was severely disturbed and potentially violent?  Was Mr. McLean's expression consistent with my supervisor later advising her employees that she feared I might kill her: that she needed to take protective measures against a homicidal assault?

I suppose we will never know the meaning of Mr. McLean's inscrutable smile.

Mr. McLean is now Akin Gump's managing partner.  When I worked at the firm, he headed up the firm's Litigation Practice Group, which included David Callet and Dennis Race, the attorney who fired me.  My supervisor Chris Robertson reported directly to Mr. McLean.   I believe that at that time Mr. McLean's office was on the firm's 12th floor -- where Edward S. Knight and Vernon Jordan had their respective offices.  At that time other firm partners who had offices on the fourth floor included Dennis M. Race, managing partner Laurence J. Hoffman, and Malcolm Lassman.

Akin Gump: What Does Jeffrey S. Wertman Know?

I worked as a paralegal at the law firm of Akin, Gump, Strauss, Hauer & Feld from March 1988 to October 1991.  From March 1988 to March 1990 I worked in the firm's Labor Practice Group for the client Eastern Airlines.

When I started working at the firm there was another paralegal named Jeffrey S. Wertman who also worked in the firm's Labor Practice Group for Eastern.  Mr. Wertman left the firm in the summer of 1988 to attend law school at The American University.  He graduated law school in the spring of 1991 and now practices law in Florida.

Mr. Wertman's office on the firm's second floor was adjacent to that of J.D. Neary, who at that time supervised Eastern paralegals.  Mr. Wertman and Mr. Neary seemed to be tight.  I had formed the paranoid suspicion that Mr. Neary had told Mr. Wertman that I was homosexual.

I have several recollections of Mr. Wertman.  On one occasion I asked him how his Aunt Rosa was.  He said he didn't have an Aunt Rosa.  He must have thought I was nuts. 

On another occasion I borrowed an IBM Selectric typewriter from his office on a weekend.  I vaguely recall that I used up the typewriter ribbon.  In any event, I know that I had some reason to leave him a note when I returned the typewriter to his office; I specifically recall signing the note "The Phantom Coder."

Coincidentally, at the time he lived in Washington, D.C. Mr. Wertman resided at a condominium located at 3701 Connecticut Avenue -- a building that is adjacent to my apartment building at 3801 Connecticut Avenue.  I remember that in about mid-July 1989 (about a year after he had left Akin Gump) I passed by Mr. Wertman as he was walking north on Connecticut and I was walking south.  He was wearing headphones.  He walked past me without acknowledging me.  I turned around and yelled out, "Hey, Wertman!"

I have a vague recollection that Senior Akin Gump counsel Richard L. Wyatt, Jr., an Eastern partner, wrote a letter of recommendation for Mr. Wertman for law school.

Akin Gump: The Actions of Lawyers are Held to a Higher Standard Than Those of Laymen

In Freedman v. D.C. Department of Human Rights, D,C.C.A. no. 96-CV-961 (Sept. 1, 1998) I argued before the D.C. Court of Appeals that the actions of the attorney managers of my former employer, the law firm of Akin, Gump, Strauss, Hauer & Feld, should be held to a higher standard than the actions of  non-attorney managers or employers.

1. Regarding Akin Gump's alleged ex parte consultation with a psychiatrist who reportedly advised two of the firm's attorney managers that a harassment complaint I had lodged against coworkers was the product of a psychiatric "disorder," I wrote (in part):

Assuming that Lassman and Race in fact consulted Dr. Ticho, it is questionable whether two experienced attorneys such as Lassman and Race, knowledgeable about the factors that might detract from the weight of a professional opinion, could credibly have believed that a complaint of harassment by an employee--with no preexisting record of prior behavioral problems--could be attributed to a psychiatric symptom associated with a risk of violence that rendered the employee not suitable for employment: and then, simply on the basis of a brief telephone conversation with a psychiatrist who never examined the employee personally.

Whether or not the employer's attorney managers were aware of the APA's position concerning psychiatric opinions offered without benefit of personal examination, DHR's finding that the employer's attorney managers--skilled in the art of impeachment of expert witnesses and therefore sensitive to the limiting circumstances that can bias an expert professional opinion--could have reasonably concluded, on the basis of the employer's restricted consultation with Dr. Ticho, that appellant's complaint of harassment was attributable to a psychiatric symptom associated with a risk of violence that rendered appellant not suitable for employment is simply "unworthy of credence." See Burdine, 450 U.S. at 256.

2. In the Brief on Appeal I pointed out that it is questionable whether the firm's managers -- all able attorneys -- could have formed a good-faith belief that a complaint of very subtle job harassment is baseless as evidence of a hostile work environment.  Note that Dennis M. Race, Esq., the attorney who fired me, started his career at the Office of Solicitor of The U.S. Department of Labor, while the firm's managing partner, Laurence J. Hoffman, started his career at the National Labor Relations Board.

In footnote 9 of the Brief on Appeal I wrote:

Appellant's complaint of harassment to the employer concerned very subtle harassment. While an unsophisticated, nonlegal employer might plausibly deem an employee's complaint based on such harassment unbelievable, it is far less convincing that knowledgeable attorney managers of a major law firm would credibly find appellant's harassment complaint "baseless as proof of sexual or religious harassment" [Rec. 138]. In fact, a complaint based on subtle harassment is legally cognizable. At least one court (in a foreign jurisdiction), noting that "sexual harassment based on the creation of an offensive, hostile and intimidating environment . . . can take many forms and is often very subtle," has permitted expert testimony to illuminate for the finder of fact the nature of plaintiff's work environment and the sexual connotations of seemingly trivial events. Eide v. Kelsey-Hayes Co., 397 N.W.2d 532, 538 (Mich. App. 1986).

Perhaps it is part of Akin Gump's southern cultural roots to "play dumb" before judicial tribunals.  I am reminded of the self-attribution of the late North Carolina Senator, Sam Ervin -- a graduate of Harvard Law School -- who used to say, "I'm just a simple country lawyer."

In fact, the U.S. Court of Appeals for the Fourth Circuit in 1991 specifically admonished Akin Gump's attorneys for implicitly attempting to discount their legal acumen and expertise.  U.S. v. Moore, 931 F.2d 245 (1991).

In a criminal matter involving the interpretation of a plea agreement the Court said:

"[Defendant] Moore has claimed that the 'spirit' of the plea agreement was violated because the United States sought a 'severe prison term' and made 'a transparent effort to influence the severity' of Moore's sentence.' The plea agreement, however, did not restrict the prosecutors as he suggests and, given the sophistication of both defendant and counsel, the argument of plea agreement violation is without merit.

[Akin Gump] Defense counsel  [the late William Hundley and Richard N. Wiedis] [have] made the argument that the 'spirit' of the deal was violated. In the case of an unsophisticated or underrepresented defendant, we might be inclined to take a less literal view of the terms of the plea agreement, but there is no adequate reason why Moore, represented by very able counsel, should not be held to his word. Governor Moore did not have a reasonable basis to believe that the prosecutor's promise to refrain from recommending a specific sentence protected him from remarks calculated to induce the Court to issue a severe prison term."

No, Akin Gump's attorneys are not simple country lawyers.  Some of them might be compulsive and clumsy liars, but they are not simple country lawyers.

An Open Letter to Richard L. Wyatt, Jr., Esq. (Hunton & Williams) -- Is Richard L. Wyatt Concealing Knowledge of a Felony?

Mr. Wyatt:

I strongly urge you to speak to the Washington Field Office of the Federal Bureau of Investigation concerning the following matters. If you have any information that could help the Bureau investigate the criminal conduct of the law firm of Akin, Gump, Strauss, Hauer & Feld, see Freedman v. D.C. Department of Human Rights, D.C.C.A. no. 96-CV-961 (Sept. 1, 1998), you have a legal duty and an ethical duty as a lawyer to disclose that information to federal law enforcement. You practiced law at Akin Gump during my tenure at the firm (1988 to 1991) and for some years thereafter. Your failure to disclose evidence of crimes could jeopardize your license to practice law.

The D.C. Office of Corporation Counsel (acting through Charles F.C. Ruff, Esq., Jo Anne Robinson, Esq., Charles L. Reischel, Esq., William J. Earl, Esq. and M. Justin Draycott, Esq.) took the position before the D.C. Superior Court in 1996 and again before the D.C. Court of Appeals in 1997 that my belief that Akin Gump's managers (a class of persons that included Vernon E. Jordan, Jr., Esq., Robert S. Strauss, Esq., Malcolm Lassman, Esq., Laurence J. Hoffman, Esq., Joel Jankowsky, Esq. and Richard L. Wyatt, Jr., Esq.) engaged in, or approved the commission of, criminal acts, specifically, approving the break-in of my residence in January 1990 and conspiring to solicit confidential mental health information from my treating psychiatrists in violation of the D.C. Mental Health Information Act of 1978 (from 1989 through 1991) -- acts that in their entirety might constitute the crime of racketeering under federal law -- was genuine. Brief of Appellee District of Columbia, Freedman v. D.C. Dept. Human Rights, D.C.C.A. no. 96-CV-961 (Sept. 1, 1998). Neither Strauss, Jordan, Wyatt, Jankowsky, Race, Lassman, managing partner Hoffman nor any Akin Gump manager disputed the D.C. Corporation Counsel's position or questioned its legal or factual relevance.

The D.C. Court of Appeals determined that a Clinical Professor of Psychiatry (Gertrude R. Ticho, M.D., now deceased) at GW offered a professional psychiatric opinion about me to Malcolm Lassman, Esq. and Dennis M. Race, Esq. in late October 1991. The U.S. Social Security Administration relied in 1993 on Mr. Race's sworn declaration about that psychiatric opinion to grant a fraudulent claim of disability insurance. Dr. Ticho's act of providing a professional psychiatric opinion about an (unnamed) individual without benefit of personal examination was a violation of the American Psychiatric Association's Code of Professional Ethics. See Goldwater v. Ginzburg, 396 U.S. 1049 (1970) (the APA's so-called Goldwater Rule prohibits a psychiatrist from offering a professional psychiatric opinion without benefit of personal examination). Information obtained by Akin Gump via Dr. Ticho's violation of the Goldwater Rule was used by Akin Gump's attorney managers to defraud the D.C. Department of Human Rights (1992 and 1993), the D.C. Superior Court (1996), the D.C. Court of Appeals (1997), the D.C. Corporation Counsel (1996 and 1997), and the U.S. Social Security Administration (1993).

You were a member of Akin Gump's management committee during my employment, which also included as a member Malcolm Lassman, Esq.  In a sworn declaration dated May 22, 1992, Dennis Race advised the D.C. Department of Human Rights that his decision to terminate my employment on October 29, 1991 was made in consultation with Akin Gump's management committee:  "After deliberating with Claimant's supervisor and other members of Respondent’s Management Committee, the decision was made to terminate Claimant."

You (as well as Jack Gallagher, Esq. and David P. Callet, Esq.) were a senior attorney for the client Eastern Airlines, the major client to which I was assigned from 1988-1990; you may have first-hand information about my employment at Akin Gump and possibly the circumstances surrounding my job termination by Mr. Race on October 29, 1991.
