APPELLANT'S RESPONSE TO APPELLEE'S 
MOTION FOR AN EXTENSION OF TIME IN WHICH TO FILE BRIEF

Whereas Appellee's brief was required to be filed on or before June 11, 1997 (see D.C. App. R. 31(a)(2)), and was not filed, and whereas said filing date neither was extended by order of this Court per Appellee's uncontested motion for an extension of time in which to file brief, dated June 5, 1997, nor stayed by the filing of said motion of Appellee, Appellant respectfully requests that Appellee's outstanding motion for extension be denied and, further, that Appellee be precluded from filing a brief and being heard at oral argument (see D.C. App. R. 31(c)).   See D.C. App. R. 27(a).
